In exchange for the intangible value “Participant” will gain by participation in the program, I hereby authorize, assign and grant permission to the Women’s Sports Foundation, its representatives, related companies, entities, and partners, without further compensation and without further approval, to use, display, transmit, publish, reproduce, digitize, alter or edit photographs, sound recordings, and/or videos of Participant and her/his/their image, likeness and voice in which she/he/they may be included in whole or in part, in composite or other reproduction thereof, in color or otherwise, made through any media for art, advertising, trade or any other lawful purpose to promote the Women’s Sports Foundation and for other non-profit purposes in furtherance of the mission of the Women’s Sport Foundation. I, as a Participant and/or as parent or guardian of a Participant, hereby waive the right to inspect and/or approve the finished product or the advertising copy that may be used in connection therewith. Participant acknowledges that the Materials may reside, be accessed, and viewed perpetually on numerous third-party platforms, including Yahoo! Sports.
Women’s Sports Foundation shall be the exclusive owner of all rights, including copyrights, in the Materials.
To the fullest extent permitted by applicable law, I, individually as a Participant and/or as parent or guardian of a Participant, as applicable, hereby irrevocably waive all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, defamation, invasion of any rights of privacy (including intrusion, false light, public disclosure of private facts, and misappropriation of name or likeness), violation of rights of publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, or any claim arising with respect to any blurring, distortion, alteration, optical illusion, or use in composite form, that may occur or be produced in the taking of said picture, or in any processing tending toward the completion of the finished product, in any case whether now known or hereafter known in any jurisdiction throughout the world (collectively, “Claims”) arising directly or indirectly from the Women’s Sport Foundation’s exercise of their rights hereunder or the production, exhibition, distribution, exploitation, advertising, promotion, or other use of the photograph, video or sound, and whether resulting in whole or in part by the negligence of Women’s Sport Foundation or any other person, and covenant not to make or bring any such Claim against Women’s Sport Foundation, and forever release and discharge the Women’s Sports Foundation from liability under such Claims. I understand that Women’s Sport Foundation is relying on this Video, Sound and Photography Release (collectively, “Release”) and will incur significant expense in producing the Materials in reliance on this Release.
If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Photography Release or invalidate or render unenforceable such term or provision in any other jurisdiction.
This Release shall be binding upon the heirs, next of kin, personal representatives, agents, executors, and administrators of the undersigned and Participant, and shall be governed by New York State law, irrespective of any choice of law principles. Any legal disputes shall be exclusively handled in a state or federal court within the Southern District of New York.
In signing the foregoing release, the undersigned hereby acknowledges and represents that he/she/they has read the foregoing Release, understands it, and signs it voluntarily as parent or guardian of Participant.
